Default Section 8 in qv?

No it's not Section 8 housing, and the tickets we receive for trash left outside the properties charge $25/item so each box, bag, piece of furniture cost us $300 the first time we received a ticket for a tenant's ignorance. We changed our leases to define clearly a $25/item charge for any possessions left. The block captain pointed out the infraction and warned that he would not call Sanitation for a few hours to give us a chance to right the tenant's wrong, which was kind of him. That's not always the case.

Weak complaint. If the owner did get a citation he could deduct it from the security deposit. It isn't rocket science but I guess the owner isn't a rocket scientist. Compared to the rest of the slobs in this city I am just glad that someone in Phila actually takes out their trash. Maybe the owner would have preferred the trash be left in the house.

Exactly. I would love to hear from our genius landlord to see what would of been the utopian solution.

They put their trash out on Saturday, JUNE 30TH-THE END OF THE LEASE.

If they kept their keys or other property on the premises, they would be bound by continuance and would of been liable for another month of rent.

If any landlord didn't want the trash to go out, they could of easily told the tenant that any trash should be placed in the back yard-then the landlord would put it out on Thursday.

Additionally, a landlord may not freely divert fines to tenants; it is the landlord's responsibility to mitigate damages prior to subjecting the tenant to financial disposition; if multiple tickets were truly given, the landlord would have several grounds on which to fight all but one of the tickets.

Our neighborhood has the same sweep team; I have never in my life received more than one ticket/day from the actions of tenants or employees-and there has certainly never been a per item fine.

However, this conversation is merely a lesson in futility...if the landlord was supposedly so diligent to give the "move out documents" with "stern warnings", they should of been there to do a final walkthrough, key exchange, security deposit settlement, etc., and all of this would of been a non-issue.

Default trash violations on a weekend

Sorry to revive this old thread, but neighbors (a bunch of single guy students) moved out and left a MOUNTAIN of trash out for pickup on Thursday, and trash pickup isn't until Tuesday (a full four days before pickup)...there's no answer at SWEEP now of course. It's pretty gross and goes the entire width of the property...do we have any recourse? I would be astounded if anyone's out writing tickets for this over the Labor Day weekend, and the owner's a total absentee landlord...grr.

yeah wow stupid landlord. tenants should probably just put out their trash whenever on any day they choose. it has to be convenient for them of course! landlord can deal with it and happily pay the fine, too.
