So, you have fallen for the propaganda Neal Boortz and others have told you about H.R. 25, the alleged fair tax? Lets get down to understanding what H.R. 25 really is!

Default SURPRISE! Sean Hannity supports H.R. 25, the alleged fair tax

It is so sad to see so many people in America, and especially those who participated in the unfair tax rally last night, ignoring our Constitution and looking for new ways to allow our domestic enemies on Capitol Hill tax and rape America’s labor and businesses.

Constitutional taxation requires the federal government to have jurisdiction over the subject matter being taxed. Taxation was one of the most, if not the most, important issue discussed during the framing of our Constitution and the framers intended to allow Congress to raise a federal revenue in a specific manner and for very specific and enumerated purposes!

The constitutional functions of our federal government were eloquently summarized in the following way:

Federalist Paper No. 45 tells us:


"The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite. The former will be exercised principally on external objects, as war, peace, negotiation and foreign commerce. ... The powers reserved to the several States will extend to all the objects which in the ordinary course of affairs, concern the lives and liberties, and properties of the people, and the internal order, improvement and prosperity of the State."

And, to support those function, James Madison, speaking before Congress during the framing of our Nation’s FIRST REVENUE RAISING ACT states:


“…a national revenue must be obtained; but the system must be such a one, that, while it secures to object of revenue, it shall not be oppressive to our constituents”


“Shall not be oppressive to our constituents!” They went on to raise their revenue over a subject matter which they were granted jurisdiction over foreign commerce! And, they then selected specific articles and imposed a specific amount of tax on each specific article chosen for taxation!

In addition, they also laid what was know as tonnage taxes…an across the board tax on imports to raise a revenue to fund the function of the federal government.

But that is not all, they also used their grant of taxing powers for the general welfare of the united States. No! The power was not intended to finance a food stamp program for permissive unwed moms, or pay for state constitutionally authorized functions such as public education, now done under the unconstitutional No Child Left Behind Act . Taxing for the general welfare of the united States meant imposing such taxes at our water’s edge which would promote America’s best interests!

And what did they do under the first revenue raising act to promote America’s best interests?

In addition to imposing a specific amount of tax on specific articles of
consumption which were imported, the first revenue raising Act also imposed an across- the-board tax on imports which was higher for imports shipped in foreign owned foreign built vessels, and discounted the tax for imports arriving in American owned American built ships:


"...a discount of ten percent on all duties imposed by this Act shall be allowed on such goods, wares, and merchandise as shall be imported in vessels built in the United States, and wholly the property of a citizen or citizens thereof."


This patriotic and skillful use of external taxation not only filled our national treasury, but gave American ship builders a hometown advantage and predictably resulted in America's merchant marine becoming the most powerful on the face of the planet. Unfortunately, today when I visit the docks in New York's Hell's Kitchen area, I am saddened that I can no longer read the names on the docked ships as they all seem to now be foreign owned foreign built vessels...an irrefutable sign of America's decline traceable to our domestic enemies on Capitol Hill.

Yes, there was a day when our national treasury was gladly filled by foreigners paying for the privilege to do business on American soil. But this was when members of Congress, and those running for Office, put American interests first and would have considered the NAFTA, GATT and the WTO as acts of sedition, and would have tarred and feathered those participating in the surrender of America's sovereignty. And especially tar and feather those Congress who now refuse to protect our borders from invasion.


Our country, is being stolen from us by a Congress in rebellion to our Constitution, who are assisted by uniformed self interested individuals who will swarm to a tax rally to support a tax which they believe will end calculating a tax from their income, but turns out to be another step to tighten the iron fist of government over the American People’s productivity.

How sad so many Americans have lost the spirit of freedom which our founding fathers intended to protect by a written constitution.

Neal Boortz should be ashamed of himself, promoting something which he knows will not do what its rallying supporters believe it will do.

Unfortunately, Sean Hannity has joined the ranks of the uniformed when it comes to tax reform and ignores what “A GREAT AMERICAN” would say with regard to tax reform:

"In matters of Power, let no more be heard of confidence in men, but bind him down from mischief by the chains of the Constitution"--- Jefferson

The 16th amendment is not repealed by H.R. 25!

I'm generally in favor of tax reform. I don't know enough about the Fair Tax to make an informed decision, although I've heard some favorable things about it. Contrast that with quoting the Federalist Papers...that's not getting me any closer to even clicking the link on what your group proposes, let alone doing full research.

Like it or not, the Fair Tax plan has an easy to digest message, which I'm sure leads to some of its popularity. Instead making your proposal read like a history lesson, perhaps you'd be better off using the old "here's the problem with the current tax system, here's how our proposal remedies it" style.

Just a thought from someone interested in tax reform.

Thank you for posting a reply. Sorry for not getting back to you sooner.

I know my posts are a bit lengthy and provide an abundance of documentation, but sometimes I feel this is unavoidable to convey a complete message.

O.K. here’s a problem with H.R. 25:


The primary supporters of H.R. 25, the FairTax, make the following claim:

“The FairTax legislation would do away with the federal income tax and replace it with a 23 percent national sales tax…”

But the above statement is misleading at best; at worst is an intentional misrepresentation, perhaps made to influence people and draw their support.

I know Neal Boortz continually makes such a claim over the air, and H.R. 25’s primary promoters claim to their audiences it would do away with the federal income tax, and such a misrepresentation of the truth may be responsible for so many unsuspecting individuals rallying for the proposals, but the truth is, the proposed legislation, if adopted, merely suspends the specific taxes mentioned in the legislation until, and if, a future Congress decides to reintroduce such taxes which may be done while keeping the newly adopted 23 percent tax on sales if H.R. 25 should be adopted.

The following points should be made crystal clear to all those who rally in support H.R. 25.

1.

Legislation enacted by a current Congress does not bind the hands of a future Congress. This is a fundamental principle of our Constitutional system. If H.R. 25 were adopted, a future Congress is free to tinker with the proposal, amend it to its liking, and slowly reintroduce the very tax which its rallying supporters understood would be ended!

2.

Even if H.R. 25 were adopted, and its wording followed to the letter, a tax calculated from profits, gains salaries and other income has been kept very much alive by a failure to include in its language a prohibition on any tax calculated from profits, gains salaries and other income. Why is this important to know? Under Congress’ power to lay “excise” taxes, which is different from the “income tax“, Congress may, and has, laid a wide variety of taxes upon businesses, individuals, certain occupation and events, and then calculated the amount of tax to be paid from profits, gains salaries and other income.

This fundamental truth provides an educated guess, that if adopted, H.R. 25 would eventually leave 10’s of millions of Americans along with various businesses, with two rule books to follow and two different kinds of record keeping to perform as Congress may so desire.

3. It is also important to note that H.R. 25 does not repeal the 16th Amendment, which I have come to learn many of H.R. 25 supporters believe will happen. But the only wording in H.R. 25 relevant to such a belief is as follows:


“SEC. 2. CONGRESSIONAL FINDINGS.

(f) FINDINGS RELATING TO REPEAL OF PRESENT FEDERAL TAX SYSTEM-

Congress further finds that the 16th amendment to the United States Constitution should be repealed_____”.

There is a very big difference between “should be repealed” and a binding provision compelling the repeal of the 16th Amendment.

It is worthy to note what a GREAT AMERICAN American [ a tag line from Sean Hannity] once said with reference to such matters:

"In matters of Power, let no more be heard of confidence in men, but bind him down from mischief by the chains of the Constitution"--- Thomas Jefferson

The only tax reform we need is to have the following words added to our Constitution brining us back to our Founder’s original tax plan.

The Sixteenth Amendment is hereby repealed and Congress is henceforth forbidden to lay ``any`` tax or burden calculated from profits, gains, interest, salaries, wages, tips, inheritances or any other lawfully realized money
