As for the issue at hand: Given the outcomes of other court cases involving Scout use of public lands, I'm afraid the Cradle of Liberty Council has a very weak case even if it paid to build and maintain the building -- I suspect the best they could hope for is reimbursement of those expenses (which if that happens may be enough to force some sort of face-saving solution, given the state of the city's own budget) -- but I don't think this was the way to recognize the efforts of a Scout council that did what it could to please two masters, and it will have a further detrimental effect on a program many city kids need (beyond that of losing automatic United Way funding over the issue, which has also happened).
