Okay--two things: (1) You always have a right to a pre-settlement walk-through. (2) If anything isn't exactly like it should be, you have the right to negotiate...for instance, if there's still stuff in the basement or a tenant in a place that is supposed to be vacant, DO NOT GO TO SETTLEMENT until it's as the contract states or else, well, you inherit the issue.

These issues are NOT uncommon--ie. contactual violations by the seller not people still living there. Several examples I've run into are sellers that think just because THEY bought a house with a basement full of lumber, paint from 1979 and two abandoned water heaters that the new owner should inherit them...another example is furniture left behind. Another is a brand new water stain in a ceiling...

Any good agent should suggest several things: (1) delaying the settlement so the seller can take care of the issue, (2) giving the buyer a credit to address the issue her/himself or (3) Holding that agent's commission check or putting money in escrow until the issue is resolved. Before choosing choice 3, a buyer should think about the legal liability involved if irresponsible seller comes back onto buyer's property and either screws something up or slips and falls.

A good agent should also suggest giving yourself a week between when you HAVE to move in and when your settlement is. That way you have flexibility if these types of things come up and you aren't forced to settle that day.

Sorry to hear about this situation but it sounds more like your friend took some bad advice and it was an easily avoidable situation. I wasn't advised properly when I moved in either...and inherited about a dumpster's worth of stuff that I had to lug about and figure out how to dispose of. But it was certainly better than inheriting people!

I hope that someday using the term "THUGS" will be viewed as wrong. People throw the term around a lot but I really find it pretty offensive and think that people would use it a lot less if at all if they stopped and thought about what it meant.

THUG doesn't bother me as far as what's thrown around on Phillyblog. "A certain element", "The brothers and the sisters", and "the blacks moving to the Northeast" gets the most mention I think.

I agree. "Thugs" is an insult to Indian-Americans (I mean Bangalore/Delhi/programmer-type Indians):

BTW, I think 50's chest is 50% airbrushed in that photo.

Probably removed some shadows to turn the botbelly into a 6pack (you can do wonders with Photoshop).

Please elaborate on what is so offensive about the word "Thug" . The word does not imply any particular group besides criminals so what's the big deal.

Yeah, the word thug has been around a hell of a lot longer than the idiots that represent today's version of a thug. It's ridiculous that ANYONE is offended by the word thug, or white trash of which there is much of in Philadelphia. LOL......
